Terms and Conditions
Participation. TripActions will randomly select two (2) eligible participants (one from each Webinar (defined below)) to win a Prize (as defined below) (the “Giveaway”). By participating in the Giveaway (including by accepting a Prize), you agree to be bound by these Terms and Conditions and by the decisions of TripActions. TripActions reserves the right to modify the Prize award procedures at its discretion. If you do not agree to these Terms and Conditions, you may not participate in the Giveaway, nor receive a Prize.
Eligibility. TripActions will host a webinar on October 14 and October 21 (each, a “Webinar”). Participants are eligible to win a Prize by registering for one of the Webinars. A participant can only win one Prize. Participants must reside in the United States and be 18 years of age at the time of the Webinar to win a Prize. No purchase is necessary to participate in the Giveaway. The Giveaway is void where prohibited, and all applicable federal, state, and local laws and regulations apply.
Receipt of Prize. Each winner will receive one (1) annual CLEAR Pass (a $179 value) (“Prize”). Winners will receive an email from TripActions within approximately two business days after being selected as a winner of the Prize announcing they have won and also an email from CLEAR with a link and instructions to claim the Prize. Winners’ emails will be shared with CLEAR in order to claim the Prize. CLEAR Terms and Conditions may apply. TripActions has the right to substitute the Prize with another comparable form of award of equal or greater value. If a Prize is undeliverable to the winner within two (2) calendar days after attempted notification, the Prize will be forfeited by the winner and awarded to subsequent randomly selected winners until the Prize is claimed. Winners may be required to complete a W9 Tax Form for the sole purpose of preparation of any tax forms as required by law.
Disclaimer. TripActions disclaims any warranty, representation, or guarantee, express or implied relative to the Prize, including its quality, fitness for purpose, or condition. ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.
Indemnity. By participating in the Giveaway (including by acceptance of the Prize), participants agree to release and hold TripActions harmless from and against any claim or cause of action (and any associated costs, losses, or damages) arising in whole or in part out of participation in the Giveaway or the receipt, redemption, or use of a Prize.
Disclaimer; Giveaway Termination. TripActions is not responsible for Prize notifications or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. TripActions reserves the right, in its sole discretion, to disqualify any individual who is found to be tampering with the entry process or the operation of the Giveaway, or who annoys, abuses, threatens, or harasses any other person. TripActions reserves the right to seek damages and other remedies from any such individual to the fullest extent permitted by law. TripActions further reserves the right to modify, extend, suspend, or terminate the Giveaway, in whole or in part, if it determines, in its sole discretion, that the Giveaway or any particular, selection of a winner is technically impaired or corrupted or that fraud or technical problems, failures or malfunction, or other causes beyond TripActions’ control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, or feasibility of the Giveaway or particular selection of a Giveaway winner as contemplated herein.
General. These Terms and Conditions cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of TripActions. The Giveaway is governed by the laws of the State of California and is subject to all applicable federal, state, and local law regulations.
